Terms and Conditions of Let of West Church Hall, Dornoch

The Congregation means the Kirk Session of Dornoch Cathedral Congregation, Scottish Charity Number SC000315.

The User means the person/group hiring the Premises.

The Premises means the West Church Hall, Dornoch, including the grassed area around the Hall building.

  1. This contract for use is a personal agreement between the Congregation and the User and cannot be assigned in whole or in part to another party.
  2. The Premises shall be used by the User for the sole purpose for which the hire was intended and the User shall ensure that their use is compliant with all statutory provisions or licencing requirements. At present the hall does not have a public entertainment licence.
  3. Admittance to the Premises must not exceed 150 people in total (120 maximum in the Main Hall and 30 maximum in the Upper Hall)
  4. The User shall ensure that insurance cover is in place for the User (including public liability cover) and all its associates and any equipment or other property brought onto the Premises to the satisfaction of the Congregation. Groups affiliated to Dornoch Cathedral are covered by its insurance. All other Hirers must exhibit a copy of their Public Liability Insurance to the Congregation. (Numerous companies provide this at a reasonable cost for one-off events.)
  5. The User will be responsible for any damage or loss caused to the Premises arising directly or indirectly from their use. The User accepts the Premises as being in a clean and tidy condition and will be responsible for the Premises being left in a clean and tidy condition and clear of all rubbish at the end of their use. In extreme cases additional costs for cleaning, repairs or loss could be levied on the User.
  6. The User must nominate a competent person to take charge in the event of Fire to ensure that all persons at the Premises can escape unimpeded through the Fire Exits. Fire exits are the front door and back door. These must not be locked or blocked during the Hire, therefore you must unlock the front door after you enter the Premises through the back door.
  7. Regular Users will be invoiced in arrears. For one-off events and business users, payment will be due in advance of the booking. For some events and functions, Users may also be asked for a deposit on booking and will be told about this when booking. The Congregation reserves the right to review hiring charges from time to time.
  8. Cancellation charges may be levied on the User at the discretion of the Congregation.
  9. No alcohol shall be sold on the premises. This includes any drink included in the price of a ticket. The User is responsible for ensuring no alcohol is consumed on the Premises by anyone under 18.
  10. Please return all tables and chairs to their original positions if you have moved them.
  11. Please do not use sticky tape, blu-tak, pins etc to fix items to any painted surface.
  12. The User is permitted to use crockery and utensils in the kitchen, but will report any breakages so that items can be replaced by the User. A Breakages Book will be found in the kitchen.
  13. Floors must be swept and tidied after use. Toilets and sinks must be left clean and tidy to the satisfaction of the Congregation. (Please do not put toilet cleaner or water in the gents urinals)

  14. Rubbish must be bagged and placed in the wheelie bin near the back door. Reclycing should be placed in the blue bin.
  15. No smoking is allowed anywhere on the Premises. No illegal drugs are allowed on the Premises.
  16. Any electrical equipment brought onto the Premises must be PAT (Portable Appliance Testing) tested.
  17. Please do not touch the heating controls.
  18. The User must ensure that all entrances to and exits from the Premises are left locked and secure when the User leaves the Premises
  19. The Congregation shall not be responsible for any loss, damage, actions, proceedings, costs, claims or demands by any party of any kind and the User shall indemnify the Congregation (including the trustees vested in the Premises) against all such loss, damage, actions, proceedings, costs, claims or demands arising from the Users use of the premises.
  20. COVID 19: Please comply with any Scottish Government regulations in place for public buildings regarding mask wearing etc. Stay vigilant and consider ventilation if your event is crowded.
  21. The User will require to be aware of and will comply with the legislation relating to the safeguarding of children and young people and will read and understand the relevant Church of Scotland Safeguarding materials and will follow their provisions. If the User is found to be in breach of these undertakings, the Congregation shall have the right to terminate this Agreement with immediate effect.
  22. All Children must be supervised. In particular, if using the grass area outside the Hall, ensure that all children remain within the fenced boundary.
  23. Please note that bookings are not normally taken over the Easter weekend.
  24. Child Protection – It is the responsibility of user groups to ensure that all paid staff and volunteer workers/helpers that are engaged in “regulated work” as defined by Child Protection legislation have registered with the PVG (Protection of Vulnerable Groups) Scheme and have approval to work with either children or vulnerable adults or both. The Church of Scotland also recommend attending a Safeguarding & Protection Children Course which are held by the Safeguarding Trainer in your area. Implementing PVG registrations is a condition of the Congregation agreeing to let the Premises to your organisation.
